We encourage you to read the terms and privacy policies of any third-party sites you visit. Linking to a third-party site does not constitute an endorsement by Bettera.
7. Disclaimer of Warranties
This Site and all content, materials, and information on it are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Bettera disclaims all warranties, including but not limited to:

8. Limitation of Liability
To the fullest extent permitted by applicable law, Bettera and its officers, directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your access to or use of (or inability to access or use) this Site or any content on it.
This includes, without limitation, damages for loss of revenue, loss of profits, loss of business, loss of data, or loss of goodwill, even if Bettera has been advised of the possibility of such damages.
In no event shall Bettera's total liability to you for all claims arising out of or related to your use of the Site exceed one hundred dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Bettera and its officers, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

If you submit any information to Bettera through this Site — including through contact forms, email inquiries, or RFP responses — you acknowledge that such information is not confidential unless we have a separate written confidentiality agreement in place. Do not submit information you consider proprietary or confidential through general web forms unless a signed NDA or confidentiality agreement is in effect.
12. No Professional Advice
The content on this Site is for general informational purposes only. Nothing on this Site constitutes legal, financial, technical, or professional advice of any kind. You should not act or refrain from acting on the basis of any content on this Site without seeking appropriate professional guidance specific to your institution's circumstances.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site following the posting of changes constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically. For material changes, we may also provide notice via email or a prominent notice on the Site.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States and the state in which Bettera is incorporated, without regard to conflict of law principles.
Any dispute arising out of or related to these Terms or your use of the Site that cannot be resolved informally will be subject to binding arbitration under the rules of the American Arbitration Association, conducted in English. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any class action or representative proceeding.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.
